Terms of Service

Introduction

In the following text, "Farda", "we", "our", "ours", and "us", all refer to Farda Technology, or every individual or company associated with Farda Technology in providing services to the Farda Technology customers.  "Customer" and "you" also refer to those who receive these services.  These terms of service have been designed to benefit both parties (Farda and its customers.)  Specifically, these terms have been designed to guarantee lawful and ethical usage of our servers, and preventing a single customer from an unjustifiable usage of system resources, and also denying any unjust (financial or non-financial) responsibility for Farda.  Farda reserves the right to edit and update these terms and conditions at any time without prior notice.  Customers implicitly agree on these terms and conditions upon purchasing and using Farda services.  If a customer at any time disagrees one or some terms of this document, the disagreement will imply agreeing to terminate the service offered to them, and Farda will have full rights to terminate the services gives to that customer, and no fees will be refunded to them.  Having no explicit disagreement with the terms and conditions outlined in this document will imply agreement to all terms of it.

Refusal of service

Farda reserves the right to refuse or cancel the services given to any certain customer in its sole discretion.  This right is not necessarily limited to the terms and conditions stated in this document.  The customer upon receiving our services agrees that any breach of one or some terms of this document on their part will lead to suspend or cancel the services offered from Farda to the customer.  Under such circumstances, the customer is responsible and will pay for any possible liability incurred to Farda in the process.

Limitation of liability

Farda cannot be held responsible for any damages that the client may suffer by usage of any of the services offered by Farda.  Farda does not give any kind of guarantee, either implicitly or explicitly, for any of the services given to a customer.  Farda disclaims any merchantability or fitness for any purpose or any other warranties.  This includes, but is not limited to, any data loss, failure in correct data delivery, failure to deliver data, or service disruption.  The customer agrees to protect Farda against any possible claims from any one in relation to any possible damages they have suffered from by using Farda services.  This includes any breach of any law or of any of the terms of this document which leads to any loss for Farda or any claims against us.  The customers further agree to pay any damages or associated costs (such as attorneys' fees) awarded against Farda or any of its staff in case we are sued because of any activities on the customer's side which violate any law or any terms outlined in this document.

Appropriate content

A customer's web site must not have any content, or a link to content, that is unlawful, pornographic, gambling-related, threatening, hateful, obscene, encouraging unlawful behavior, or related to nudity, hacking or pirated software (other than in the context of securing computer systems or countering hacking or pirating software), drinking, smoking, or drugs.  Farda reserves the sole right to indicate whether a site's content or not, even in case they have content of a category not listed here, but that is deemed unacceptable by Farda.  Sites which Farda indicates as having unacceptable content will be removed from our servers without prior notice, and we will not refund any fees to the offending customer.

Copyright and infringement

Material available to you while using Farda services might be protected by local or international copyright laws or trademark laws, or laws protecting trading secrets and proprietary information for a particular country.  The customer must not use this material in a way offending any such laws about the material provided to you by Farda, except where the owner of that material explicitly permits the customer to do so.  If a customer uses a domain name provided by Farda or a third party in conjunction with other services we offer, that domain name must not violate any trademark, service marks, of any third party.  The customer is fully responsible for any such violations of laws, and releases Farda from any liability of such violations.

Spam (Unsolicited bulk e-mail)

Spamming (sending unsolicited bulk e-mails) from our servers is strictly prohibited.  In addition, the customer is not allowed to use the e-mail address with a domain name hosted by Farda to send any spam or unsolicited bulk e-mails.  If we, at our sole discretion, determine that a customer has somehow violated this, the services offered to them will be canceled immediately.

Bandwidth and disk space usage

Upon completion of the signup form, the customer agrees not to exceed the bandwidth limit or disk space usage limit of their chosen web hosting package.  If the customer exceeds any of these limits, they are responsible to pay any additional fees stated in the price list for additional disk space or bandwidth usage.  Refusing to pay this fee will lead to termination of the services offered to the customer.  The customer, upon exceeding the disk space or bandwidth usage, is required to purchase a complete package of additional disk space or bandwidth, as stated in the web hosting services page, and is required to pay the associated fees with the purchased package.

Payments

The fees associated with any of our services must be paid in advance of the service.  This is true for the monthly, yearly, or multi-yearly services.  Also, no fees paid by a customer to Farda are refundable, except in the circumstance outlined below.  In case that customers are required to pay any additional fees, according to the terms stated above, the services provided to them by Farda will be discontinued if the additional payments are not received by Farda in a week period.

Refunding of fees

If during the first 30 days of the start of a web hosting service, a customer is not satisfied with the web hosting service offered by Farda, and Farda indicates that this dissatisfaction is justifiable, Farda is responsible to fully refund the fee that the customer has paid for the web hosting service.  Determining the justifiability of the dissatisfaction is at sole discretion of Farda's technical staff.  Cases where a dissatisfaction is considered justifiable include, but are not limited to, a technical failure in delivery of the services.  It should be noted that the customers are responsible to know exactly the web hosting technology we offer to them in advance of purchasing the service, and dissatisfactions caused by customer's misconception of the web hosting features (like a customer stating that they wanted a Windows-based hosting technology) are not justifiable.

Reseller Accounts

Resellers are not permitted to expand any of the terms and conditions in this document beyond or in contrast to the Farda terms of service.

Local law

If any part of these terms and conditions are contrary to a local law, then the terms and conditions are implicitly modified only to the extent necessary to be considered legal and enforceable by such locality only.
